Welcome to the xView Challenge!

These Terms and Conditions ("Terms") apply to the xView Challenge sponsored by the Defense Innovation Unit Experimental (DIUx) (the "Challenge"). Please read these Terms carefully as they form a binding legal agreement between you and the Challenge Sponsor. As owner of this website, DIUx may revise the Terms at any time by posting an updated version to this website without notice.

CHALLENGE SPONSOR: Defense Innovation Unit Experimental (DIUx) ("DIUx") with respect to the Challenge. DIUx is sponsoring the xView Challenge under the authority granted in 10 U.S.C. 2374(a).

YOU MAY NOT SUBMIT AN ENTRY TO A CHALLENGE UNLESS YOU AGREE TO THESE TERMS. YOUR SUBMISSION OF AN ENTRY IN THE XVIEW CHALLENGE CONSTITUTES YOUR AGREEMENT TO THE CHALLNEGE TERMS, CONDITIONS, AND RULES. YOUR SUBMISSION OF AN ENTRY CONSTITUTES A CONTRACT BETWEEN YOU AND THE U.S. GOVERNMENT.

1. Challenge Structure.

1.1 Overview. The Challenge requires participants is to provide a machine learning classifier that can correctly classify objects in overhead images.

1.2 Submissions. You must submit your solutions for problems through the Challenge Website.

(A) Your submission must be in the format specified by the task, the Challenge Website, and these Terms (with precedence given in that order). Deliberately obfuscated source code is not allowed.

(B) Solutions submitted after the applicable deadline will not be accepted.

1.3 Communications. All communications between DIUx and you, including the Challenge Website and email communications, will be in English.

1.4 Modifying the Challenge. DIUx may cancel or modify the structure, location, and times of the Challenge to run the Challenge in accordance with these Terms or to prevent an unfair result.

2. How to Enter.

2.1 Registration. To enter the Challenge, you must register at the Challenge Website and provide the required information about yourself.

(A) Registration times will be listed on the Challenge Website. YOU ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME IN YOUR TIME ZONE.

(B) You may only register for the Challenge with one valid email address. If you compete in the same Challenge with multiple email addresses, you will be disqualified.

2.2 Screen Names. DIUx reserves the right to change or omit participant screen names or nicknames for purposes of publication on websites or listserv, particularly if they are, in DIUx's sole opinion, obscene or violate the intellectual property rights of others.

3. Requirements to Enter, Eligibility, and Disqualifications.

3.1 Requirements to Enter.

(A) In order to enter the Challenge, you must have:

(1) a U.S. Social Security Number or Taxpayer Identification number;

(2) access to the Internet, and;

(3) a valid email address.

(B) If you are a government official, you may only enter the Challenge in your personal capacity and may be ineligible to receive certain benefits awarded to Challenge winners. "Government officials" include any governmnet employee; candidate for public office; and employee of government-owned or government-controlled companies, public international organizations, and political parties. Federal employees acting outside the scope of their employment should consult their ethics official and appropriate management before participating in the Challenge.

3.2 VOID WHERE PROHIBITED. The Challenge is void in Iran, Crimea, North Korea, Sudan, Syria, or other countries prohibited on the U.S. State Department State Sponsors of Terrorism list (due to Office of Foreign Assets Control (OFAC) restrictions), and where prohibited by law. Please check your local laws before entering.

3.3 NO PURCHASE OR FEE NECESSARY TO ENTER OR WIN. You do not need to purchase any product or service to enter or win the Challenge. No entry fee is required.

3.4 Ineligible individuals.

(A) You cannot participate in the Challenge if you are, and will be immediately disqualified and forfeit all of your prizes if you become:

(1) a resident of Iran, Crimea, Cuba, North Korea, Sudan, Syria, or other countries prohibited on the U.S. State Department State Sponsors of Terrorism list (due to OFAC restrictions), and where prohibited by law;

(2) restricted by applicable export controls and sanctions programs. Individuals on the Specially Designated Nationals and Blocked Persons list promulgated and amended, from time to time, by the United States Department of the Treasury (see www.treasury.gov/resource-center/sanctions/SDN-List/Pages/default.aspx for additional information);

(3) a current employee (including intern) or contractor of DIUx, the National Geospatial Intelligence Agency (NGA), or their affiliates who have had access to the xView dataset prior to its public release; or

(4) an immediate family member (including a parent, sibling, child, spouse, or life partner regardless of where you live) of one of the individuals listed in subsection (3) above or you are a member of their household (whether related or not).

(5) Under 18 years of age on the day the Challenge commences.

3.5 Disqualifications.

(A) You may be disqualified from the Challenge and forfeit any prizes you may be eligible to receive if DIUx reasonably believes that you have attempted to undermine the legitimate operation of the Challenge, including:

(1) Providing false information about yourself during registration or concerning your eligibility;

(2) Breaching or refusing to comply with these Terms;

(3) Tampering or interfering with administration of the Challenge or with the ability of other participants to participate in the Challenge;

(4) The Challenge administrators determine that you have failed to comply with the Challenge Rules. This determination is at their sole discretion.

(5) Submitting content that:

(a) violates the rights of a third party,

(b) is lewd, obscene, pornographic, racist, sexist, or otherwise inappropriate to the Challenge, or

(c) violates any applicable law; or

(d) violates the U.S. Department of Defense Social Media User Agreement at www.defense.gov/socialmedia/terms-of-service.aspx (the "Agreement"). Using discussion forums connected with the Challenge constitutes your agreement to comply with the Agreement.

(B) Threatening or harassing other participants or DIUx, including their employees and representatives. Harassing behavior includes, offensive, threatening, and/or hateful comments directed toward an individual or protected class (gender, sexual orientation, disability, gender identity, age, race, religion, ethnicity, veteran status), the use or display of sexual images in public spaces, deliberate intimidation, stalking, following, taking unwelcome photos/videos, sustained disruption of talks or other events, inappropriate physical contact, unwelcome sexual attention, and developing and/or promoting any applications designed to encourage any of these behaviors.

(C) The U.S Government reserves the right to disqualify anyone who brings discredit to the U.S. Government or whose actions could reasonably be expected to do so. This includes associations with an organization that might bring discredit to the United States Government, such as hacker groups.

3.6 Verifying Eligibility. DIUx reserves the right to verify your eligibility and to adjudicate on any dispute at any time. You agree to provide DIUx with any proof of eligibility requested by DIUx and your refusal or failure to provide such proof within 10 days of DIUx and NGA's request will result in your disqualification from the Challenge and forfeiture of any prizes.

3.7 Reporting. You may report to DIUx any harassment, cheating, or violation of these Terms by another participant. DIUx may investigate any such allegations and all decisions by DIUx in these matters are final and binding. If you are asked to stop any harassing behavior, you are expected to comply immediately.

4. Rules, Ranking Participants, Prizes.

4.1 All Challenge Rules posted on xviewdataset.org are binding under the Challenge Terms & Conditions

4.2 Rules Regarding Teaming. Solvers may collaborate with others but only the individual registered for the Challenge will be eligible for prizes. However, collaboration with any resident of Iran, Crimea, Cuba, North Korea, Sudan, Syria, or other country prohibited on the U.S. State Department State Sponsors of Terrorism list; on the specially designated nationals and blocked persons list will disqualify an entrant.

4.3 Ranking Participants.

(A) Highest Score First. Participants will be ranked in order of the highest score first and lowest score last.

(B) Ties Ranked by Submission Time. In the event of a tie between participants, the one with the earliest submission time will be ranked first while the one with the latest submission time will be ranked last. DIUx reserves the right to break ties when necessary based on finer time precision than is specified on the scoreboard.

4.4 Prizes.

(A) Participants who submit solutions ranked 1st, 2nd, 3rd, 4th, and 5th on the private test dataset at the conclusion of the Challenge will be eligible for prizes.

(B) Participants whose submissions meet performance thresholds specified in the Challenge Rules will be eligible for prizes.

(C) Participants who are currently enrolled as an undergraduate student will be eligible for a category prize. To be eligible for the undergraduate category, you must be a matriculated, full-time undergraduate student able to provide proof of enrollment upon request.

(D) Participants who agree to release an open source version of their submission under any one of the following open source licenses will be eligible for incentives: Apache 2.0, BSD, LGPL, or MIT.

(E) Winners will be considered eligible to be awarded other transaction instruments as a result of the Challenge under the authority granted in 10 U.S. Code ยง 2371b, as amended.

4.5 Requirements to Win Prizes.

(A) To receive a monetary prize, participants must provide a U.S. social security (SSN) or taxpayer identification number (TIN). Information on how to obtain a TIN is available on the U.S. Internal Revenue Service website at www.irs.gov

(B) To receive a prize for undergraduate university students, participants must provide proof of enrollment.

(C) The Government reserves the right to withhold prizes to ineligible and disqualified individuals.

4.6 Notice of Winners and Results of Challenge.

(A) Announcement of Winners. The results of the Challenge will be posted on the Challenge Website after its completion. Posted results will include a list of the participants' names or nicknames in ranked order based on their scores.

5. Ownership, Rights in Your Submissions, Privacy.

5.1 License to Use Content; Reservation of Rights. You may use the data and content made available on the Challenge Website to prepare for and compete in the Challenge. DIUx and NGA are releasing the xView dataset under an Attribution-Noncommercial-ShareAlike 4.0 International (CC BY-NC-SA 4.0) license.

5.2 Ownership of Submissions. You retain all rights to your submissions of output files and source code that you had before submitting them to the Challenge.

5.3 License to Submissions.

(A) For any winning submission you make to the Challenge, you grant DIUx and NGA a non-exclusive, worldwide, perpetual, irrevocable, free license (with the right to sublicense) to reproduce, prepare derivative works of, distribute, and otherwise use such submission, pursuant to U.S. Federal law.

(B) For any submission you make to the Challenge, you grant DIUx and NGA a non-exclusive, non-transferable, worldwide, limited license (without the right to sublicense), to view, download, use and reproduce such submission only for the purpose of internal evaluation, pursuant to U.S. Federal law.

5.4 Privacy.

(A) How DIUx May Use Your Information.

(1) DIUx will use the information you provide during registration and in any subsequent communications to administer the Challenge (including verifying your eligibility to participate in the Challenge and delivering prizes).

(2) Sharing Your Information. Your name and username you create during registration may be displayed publicly on the Challenge Website. If you win a prize, DIUx may share your name and address with third parties to fulfill awarding a prize to you.

(3) Accessing Your Information. You may access, review, and update any of your personal data held by DIUx in connection with the Challenge by emailing DIUx via the contact information listed on the Challenge website.

6. Your Representations, Warranties, Indemnities.

6.1 Representations and Warranties. You represent and warrant that:

(A) the information you provide about yourself while registering or in subsequent communications with DIUx is truthful and accurate;

(B) except as permitted by these Terms, your submissions to the Challenge are original and not created with the assistance of any information about the problems not provided by DIUx;

(C) you own all rights in your submissions or otherwise have the right to submit your submissions to DIUx and grant to DIUx the licenses granted in these Terms without violating any rights of any other person or entity or any obligation you may have with them; and

(D) your submissions do not violate any applicable laws.

6.2 Indemnities. You will indemnify DIUx and its affiliates, directors, officers, employees against all liabilities, damages, losses, costs, fees (including legal fees), and expenses relating to any allegation or third-party legal proceeding to the extent arising from:

(A) your acts or omissions in relation to the Challenge (including your use or acceptance of any prize and your breach of these Terms); and

(B) your submissions violating any rights of any other person or entity or any obligation you may have with them.

7. Disclaimers.

7.1 THE CHALLENGE WEBSITE AND ALL CONTENT (INCLUDING SOURCE CODE) IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DIUX DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES (EXPRESS OR IMPLIED), INCLUDING ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. DIUX IS NOT RESPONSIBLE FOR ANY INCOMPLETE, FAILED, OR DELAYED TRANSMISSION OF YOUR APPLICATION INFORMATION OR SUBMISSIONS DUE TO THE INTERNET, INCLUDING INTERRUPTION OR DELAYS CAUSED BY EQUIPMENT OR SOFTWARE MALFUNCTION OR OTHER TECHNICAL PROBLEMS. YOU USE ALL SOURCE CODE AVAILABLE ON THE CHALLENGE WEBSITE AT YOUR OWN RISK.

7.2 REFERENCE HERIN TO ANY SPECIFIC COMMERCIAL PRODUCTS, PROCESS, OR SERVICE BY TRADE NAME, TRADEMARK, MANUFACTURER, OR OTHERWISE, DOES NOT CONSTITUTE OR IMPLY ITS ENDORSEMENT, RECOMMENDATION, OR FAVORING BY THE UNITED STATES GOVERNMENT.

8. General.

8.1 Not an Offer or Contract Of Employment.

(A) You acknowledge that your participation is voluntary.

(B) You acknowledge that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between you and DIUx and that no such relationship is established by your submission of an entry to the Challenge.

(C) You understand and agree that nothing in these Terms, any Rules, a submission into the Challenge, or an award of a prize may be construed as an offer or contract of employment with DIUx.

8.2 Severability. If any term (or part of a term) of these Terms is invalid, illegal or unenforceable, the rest of the rules will remain in effect.

8.3 Translations. In the event of any discrepancy between the English version of these Terms and a translated version, the English version will govern.

8.4 Governing Law. ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS WILL BE GOVERNED BY LAWS OF THE UNITED STATES OF AMERICA.
